What the Courts Are Saying . . .
In addition to updating our readers on the Dugan & Meyers case, this month’s column sums up five recent opinions from as many courts. The first two deal with prevailing wage and come from the Ohio Supreme Court and the Court of Appeals for Williams County. Then we look at what an Indiana Court of Appeals had to say about a contractor’s liability for an accident allegedly caused by completed and accepted work. The Court of Appeals for Wood County supplied our fourth decision, explaining who pays for relocating utilities in connection with widening a road. Finally, we examine a federal opinion (from the Northern District of Ohio) resolving a dispute between a contractor’s bank and the same contractor’s surety.
