What the Courts Are Saying . . .
In keeping with our new focus, our five cases this month come from three states, starting with Ohio, where we look at decisions by the Ohio Supreme Court (on whether a sewer can be bid as part of a road improvement project) and two different Courts of Appeals (Butler County on whether all suits against the State for damages must be brought in the Court of Claims, and Franklin County on whether a contractor's insurance policy should cover a subcontractor's defective workmanship). Then we review a recent decision from the Michigan Court of Appeals on an unjust enrichment claim brought against a contractor by a supplier the subcontractor neglected to pay. Finally, we look at what another Court of Appeals--this time from Indiana--has to say about unjust enrichment and the question of who owns retainage.
