What the Courts Are Saying . . .
For our hospital construction issue, we chose our first case because the
dispute arose from the construction of a medical center. The Federal court in
Kansas looked at an issue with broader appeal, though: a subcontractor’s “pass
through claims.” Our second case, also from a Federal court (the Northern
District of Ohio), deals with a long-running eminent domain dispute. The lone
Ohio Court of Appeals case this month comes from Lawrence County and explores
one way an employer might be able to recoup some of its losses when its
workers’ compensation premiums balloon because of an accident on a construction
site. Finally, our fourth case is really an administrative decision from the
Occupational Safety & Health Review Commission. The subject? OSHA’s
“Multi-Employer Citation policy.”
